Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, mobile/web application and services provided by Energize.fit, operated by Shahid Khan (Sole Proprietor), based in India with her registered office at 1182 Prestige Brooklyn Heights, Kanakapura Main Road, 1st Phase J.P. Nagar, Bengaluru — 560078, India (collectively, "Energize.fit", "we", "us"). By creating an account or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under Indian law.

2. Your account

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current information and keep it updated.
• You must not share your account, resell access, or use the Services on behalf of others without permission.
• We may suspend or terminate accounts that violate these Terms or appear fraudulent.

3. Subscriptions, billing & auto-renewal

• Energize.fit offers free trials and paid subscription plans (Core, Core+, Human Premium). Pricing and features are listed on our Pricing page and may change with notice.
• Payments are processed via Razorpay. By starting a paid plan, you authorize Razorpay to charge your selected payment method on a recurring basis until you cancel.
• You can cancel anytime from Profile → Subscription. Cancellation stops the next renewal; you continue to enjoy paid features until the end of the current billing cycle.
• Failed payments may result in service downgrade to free tier.

4. Refunds

All sales are final. Refunds are governed by our Refund Policy — please read it carefully before purchasing.

5. License to use the Services

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial wellness purposes, subject to these Terms.

6. Acceptable use

You agree not to:

• Reverse engineer, scrape, or copy any part of the Services.
• Use the Services to violate any law, infringe IP rights, or harm any person.
• Upload malicious code, spam, or attempt to disrupt our infrastructure.
• Misuse AI features to generate unlawful, harmful, or misleading content.
• Resell, sublicense, or commercially exploit content generated by the Services without our prior written consent.

7. AI-generated content

Meal plans, insights, and chat responses are generated using AI models and the inputs you provide. AI output may be inaccurate, incomplete or biased. You are responsible for reviewing it before acting on it. AI output is not medical advice — see Section 9 and our Disclaimer.

8. User content

You retain ownership of content you upload (food logs, photos, journal entries, reports). You grant us a worldwide, royalty-free license to host, process and display this content solely to operate the Services, personalize your experience, and (in aggregated, de-identified form) improve our products.

9. Not medical advice

Energize.fit is a wellness and lifestyle platform, not a medical service. The Services do not provide medical diagnosis, treatment, or prescription. Always consult a qualified physician before making significant changes to your diet, exercise, medication, or treatment plans, especially if you have a pre-existing condition, are pregnant, or are taking medication.

10. Coach / nutritionist services

Premium plans may include access to a registered nutritionist or wellness coach. Coaches provide general guidance based on the information you share. Coach guidance is not a substitute for medical care and does not create a doctor-patient relationship.

11. Intellectual property

Energize.fit, our logos, brand, software, designs, content libraries (including the food database) and all related IP are owned by us or our licensors. Nothing in these Terms transfers any IP to you.

12. Third-party services

The Services use third-party providers (Razorpay, AI providers, email delivery, hosting, analytics). Your use of those features may also be subject to their respective terms. We are not responsible for third-party services we do not control.

13. Termination

You may close your account anytime via Profile → Delete my account. We may suspend or terminate your account if you breach these Terms, misuse the Services, or for legal/compliance reasons.

14. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant any specific health, fitness, or weight outcome.

15. Limitation of liability

To the maximum extent permitted by law, Energize.fit and its founders, directors, employees and affiliates are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, data, goodwill or health outcomes arising from your use of the Services. Our total aggregate liability for any claim shall not exceed the amount you paid us in the 6 months immediately preceding the claim.

16. Indemnity

You agree to indemnify and hold harmless Energize.fit and its team from any claim, loss or expense arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

17. Governing law & jurisdiction

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka, except where applicable consumer law gives you the right to file in your local jurisdiction.

18. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 7 days before they take effect. Continued use after changes means you accept the updated Terms.
